(1) If the foreign bidder has appointed an agent in Nepal while submitting the bid, he should mention the following details regarding such agent:-
(a) Name and address of agent,
(b) the base, currency and mode of payment of the commission to be received by the agent,
(c) any other condition of the Agents,
(d) If he is a local agent, a certified copy of his permanent account registration certificate and a letter accepting him to be an agent.
(2) When the agent under sub-rule (1) submits the bid on behalf of the foreign bidder, he shall clearly mention the matters mentioned in clauses (b) and (c) of sub-rule (1).
(3) If the foreign bidder does not clearly disclose the matters mentioned in sub-rule (1) or if it is later proved to be an agent for submitting the bid as not being a local agent, or if it is proved that the agent has taken more commission due to understating the commission given to the agent, then such bidder shall be blacklisted in accordance with this regulation. Action should be taken.
